Our Agency
This document sets out the terms and conditions which will apply in relation to any assignment (which includes any work for Fairytale Promotions of any kind) that you undertake for Fairytale Promotions. However, Fairytale Promotions shall not be obliged to provide you with any assignments and if you are offered any assignments, you are not obliged to accept. As such, you and the Agency agree that there is no wish or intention to create or imply any mutuality of obligation during the course of this Agreement. Nevertheless, by accepting any assignments you agree that it will be on the basis of these terms and conditions.
(Fairytale Promotions will seek to secure the best terms commercially possible with clients and will pay attention to good working conditions, hours and fees.)
Terms Of Booking
When an assignment is booked between Fairytale Promotions and a client, when we will offer you work on the assignment and you accept, Fairytale Promotions will verbally agree that you are confirmed and contracted for the booking. A booking email is then sent out to you as a written contract. This should be read thoroughly and then you should reply to the email confirming you accept our Terms of Booking. It is imperative that the brief is to be adhered to at all times. Along with the booking email / confirmation you will be sent a fee payment request form which must be completed and returned within 7 days of completion of the assignment. Failure to return this may result in non-payment.
The agreed daily rate for any assignment shall accrue on an hourly basis, pro rated to the number of hours you agree to work against the daily rates. The agreed daily rate will be inclusive of holiday pay and all expenses must be pre agreed with Fairytale Promotions at the time of booking.
Fairytale Staff
Your relationship with our Agency is that of a self employed contractor and not an employee. On acceptance of work we will send you a form to complete and sign stating you are responsible for your own Tax and National Insurance contributions, Fairytale Promotions cannot be held liable for any Taxes and National Insurance Contributions in respect of the fees for the period payable to you.
Cancellations & Punctuality
Punctuality is essential. Fairytale Promotions expects you to allow yourself plenty of time to get to the venue taking into account all eventualities. If you are going to be late at any time please contact us immediately and be aware that Fairytale Promotions may deduct from your fees an hour or part of the fee that you are not working.
If you are ill or cancel an agreed assignment you must notify the Agency at the earliest possible opportunity and provide a doctors note after explaining your reasons to Fairytale Promotions. Failure to comply with this may result in you not being offered any future assignments by us (although we cannot ever guarantee that you will be offered future assignments anyway) . You will not be paid for any work not undertaken in regards to the above.
If you are removed from an assignment at any time due to you being unsatisfactory eg client complains, poor mystery shopping report etc you may not be paid for the days you have completed and you will not be paid for any days that you do not work.
Etiquette / Code Of Conduct / Appearance
Fairytale Promotions requires a high standard of professionalism. Politeness, punctuality, reliability and enthusiasm are required at ALL times. Remember you are representing the brand, Fairytale Promotions and yourself.
- Briefs should be read thoroughly and all key messages read and remembered.
- Please refer to your brief for individual assignments and adhere to all various clothing requests eg. (No Ugg Boots or Hair Tied Up)
- Jewellery must be kept to a minimum with only wedding bands, small / stud earrings and watch permitted
- All women must have hair neat and tidy and make up must be kept to a minimum unless otherwise stated
- All men must be clean-shaven and well groomed.
You must not:
- Change your appearance without notifying the agency
- Replace yourself with someone on a job you are booked on,
- Dump ANY leaflets or distribute multiple leaflets over and above instructions in booking guidelines
- Take any stock without the Event Manager's permission, This will be treated as theft !
- Leave a job early without consent - even if you have run out of stock or leaflets
- Sample cigarettes or alcohol to under 18's and you must not sample to ANY under 18's without parental consent
- Use mobile phones during working hours, except contact to and from Fairytale Promotions.
- Smoke, eat or chew gum unless on an allocated break and you must cover any branded clothing on all breaks.
- No drugs or alcohol are to be consumed at any time (including breaks)
If uniforms are provided they must be worn in full at all times (and covered in breaks). You must follow the instructions on the brief at the end of the activity which will state whether Uniorms must be sent back to Fairytale Promotions, given to Event managers or they are yours to keep. Any missing uniform costs incurred to Fairytale Promotions will be deducted from your wages.
When working for Fairytale Promotions it is imperative that you remain pro-active throughout the day and remember you are representing the brand and every interaction with the public must be a positive one.
If any of the above is not adhered to then this may result in non-payment of your fee and could result in you not being offered any future assignments by Fairytale Promotions. Although you have no right to be offered future assignments.
Event Managers/Team Leaders
It is the responsibility of Event Managers and Team Leaders to ensure the smooth running of any activity. You are representing Fairytale Promotions at all times and the Event Manager or Team Leader will be asked to provide feedback on each individual. A separate brief will be sent to Event managers and Team leaders and you must comply with all the terms on their brief. It is the Event Manager's or Team Leaders responsibility to arrange suitable rotas for breaks for staff and ensure everyone representing Fairytale Promotions adheres to our code of conduct.
Please check any vehicle you are assigned on an activity in detail before signing to confirm as failure in returning the vehicle in the condition it was given will result in penaltys being charged and taken from any amount owing in fees from Fairytale Promotions.This policy applies to all equipment including staff uniforms and technology. You must not use any assigned vehicle for non Fairytale Promotions work.
If any expenses are incurred without prior knowledge of Fairytale Promotions for example ( speeding tickets, parking fines and the misuse or loss of stock, uniforms etc as stated above) then we have the right to deduct that amount from your fee. Persistant misuse or loss of stock, Uniforms etc may result in you not being offered any future assignment by Fairytale Promotions, although as previously stated above you have no right to be offered future assignments.
Payment
Your fees will be confirmed on your booking email and all expenses and rates of pay must be agreed when Fairytale Promotions book you for an assignment. Payment will be made within 90 days of receipt of payment request form. We normally pay at the end of the following month that you worked for example (If you worked in January, you would be paid at the end of February etc). This is subject to Fairytale Promotions and the Client being entirely satisfied with your performance.
As stated above, If you are removed from an assignment at any time due to you being unsatisfactory eg client complains, poor mystery shopping report etc you may not be paid for the days you have completed and you will not be paid for any days that you do not work.
If you are working with the client, under no circumstances must you discuss your payment with the client. This is confidential information and will result in you not being offered any future assignments by Fairytale Promotions and you may be removed immediately from the assignment and therefore will not be paid as stated above.
Transfer Periods
Once you have started a campaign/assignment with Fairytale Promotions and any particular client, you are NOT allowed to work directly for this client for 6 months. Should you ignore this term and work directly for the client introduced by Fairytale Promotions, both you and the client are liable for up to £1000 fine. Confidentiality Agreement
As a self employed contractor for Fairytale Promotions you are of course free to work for any other agency or any company at any time (unless previously booked by us). However, you must ensure that you do not at any time use or divulge any trade secrets or confidential information belonging to Fairytale Promotions, it's partners or it's clients. At the end of each agreed assignment, you will return to the agency or destroy (as instructed) all property and literature belonging to the Agency or its clients, which have come into your possession during the assignment, and you will not retain any copies.
Model / Photo Release
By accepting all the above I hereby give Fairytale Promotions permission to use the images I supply for any purpose (except pornographic, defamatory, or otherwise unlawful) which may include, among others, advertising, promotion, marketing and website use. I agree that the Images may be combined with other images, text and graphics, and cropped, altered or modified.
I agree that I have permission to upload these images, and all rights to the images belong to me. I acknowledge and agree that I have no further right to additional consideration, and that I will make no claim for any reason to Fairytale Promotions.
I acknowledge and agree that this Model / Photo Release statement and the whole of the above is binding and I accept the terms and conditions.
I agree that this acceptance will be governed by the Laws of England and I am happy to proceed with my registration.
